PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDIA CONSENT, AND CODE OF CONDUCT

By registering and checking the acknowledgment box below, I confirm that I am the parent or legal guardian of the minor participant (“Participant”) and agree to the following on behalf of myself and the Participant:

1. ORGANIZATION & SCOPE

This agreement applies to Ojai Alliance FC, including its current operating entity Vaya Con Dias LLC, and any successor organization, affiliated nonprofit entity, AYSO Alliance program, or other entity operating under the Ojai Alliance FC name (collectively, the “Club”).

This agreement applies to all Club-related activities, including but not limited to:

  • Tryouts and player evaluations

  • Training sessions and practices

  • Games, scrimmages, and matches

  • Camps, clinics, and team events

  • Local and out-of-area tournaments

  • Team travel and transportation related to Club activities

  • Use of third-party facilities, fields, and venues

2. ASSUMPTION OF RISK

I understand that participation in youth soccer involves inherent risks that cannot be eliminated, including but not limited to:

  • Physical contact with other players

  • Falls, collisions, and contact with equipment or goalposts

  • Concussions and other head injuries

  • Muscle strains, fractures, or serious injury

  • Heat-related illness and dehydration

  • Uneven, wet, or outdoor field conditions

  • Travel-related risks associated with tournaments and events

I voluntarily assume all known and unknown risks associated with participation in Club activities.

3. MEDICAL CONSENT & INSURANCE

I certify that the Participant is physically able to participate and that I have disclosed any relevant medical conditions, allergies, or limitations.

In the event of an emergency, I authorize the Club and its representatives to obtain medical treatment for the Participant as reasonably necessary.

I understand that I am financially responsible for all medical care provided. I confirm that the Participant is covered by medical insurance or that I accept full responsibility for medical expenses.

4. RELEASE OF LIABILITY

To the fullest extent permitted by California law, I hereby waive, release, and discharge the Club and its directors, officers, coaches, assistant coaches, trainers, referees, team managers, employees, independent contractors, volunteers, and agents (“Released Parties”) from any and all claims, demands, or causes of action arising from the Participant’s participation in Club activities, including claims based on the ordinary negligence of the Released Parties.

This release does not apply to gross negligence or willful misconduct.

5. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, costs, or expenses (including attorneys’ fees) arising from the Participant’s participation in Club activities or my failure to comply with this agreement.

6. TRYOUTS & SELECTION

I understand that participation in tryouts does not guarantee placement on any team. Team selection is at the sole discretion of Club coaches and staff.

This agreement applies regardless of whether the Participant is selected for a team.

7. CODE OF CONDUCT & REMOVAL

I agree that the Participant and all parents/guardians will:

  • Follow Club rules, policies, and safety guidelines

  • Demonstrate respectful behavior toward players, coaches, referees, and families

  • Refrain from abusive, threatening, or disruptive conduct

The Club reserves the right to suspend or remove any Participant or parent/guardian whose behavior is deemed unsafe, disruptive, or detrimental to the Club community. Removal may occur without refund.

8. MEDIA CONSENT

I grant permission to the Club to photograph, video record, or otherwise capture the Participant’s image or likeness during Club activities. I understand that such media may be used for Club-related purposes, including the Club’s website, social media, marketing materials, and communications.

I understand that no compensation will be provided and that media will not be used for commercial endorsement of third-party products. Families with extraordinary privacy or safety concerns must notify the Club in writing prior to participation.

9. GOVERNING LAW & VENUE

This agreement shall be governed by the laws of the State of California. Any legal action shall be brought exclusively in Ventura County, California.

10. ACKNOWLEDGMENT

I acknowledge that I have read and understand this agreement, that I am voluntarily giving up certain legal rights, and that I have the legal authority to sign on behalf of the Participant.
